3D Model files which are sold on CactusCraft (cactuscraft.info) are available under a standard license. These files are forbidden to use for commercial purposes, they are for personal use only. 3D model or any part of it in a digital or physical form cannot be shared, redistributed, duplicated or sold.

Responsibility for Listed Models

The Platform operates as a marketplace for the sale of digital models created by independent creators as well as models created by the Platform operator.

The creator or entity that publishes and offers a model for sale on the Platform is solely responsible for the content, quality, functionality, legality, originality, and compliance of the model with the rights of third parties. The Platform operator shall not be liable for any defects, infringement of intellectual property rights, or any damages arising from the use of models created and published by third parties.

The role of the Platform operator is limited to providing the technical infrastructure that enables creators to publish, offer, and sell their models. The Platform operator is not a party to any legal relationship concerning the ownership or licensing of intellectual property rights relating to models created by third parties and assumes no responsibility for their content unless otherwise required by applicable law.

For models created and published directly by the Platform operator, the Platform operator shall be responsible for their content, quality, and compliance with applicable laws.

By publishing a model on the Platform, each creator represents and warrants that they have all necessary rights and authorizations to offer the model for sale and that the publication and sale of the model do not infringe any third-party rights or violate any applicable laws or regulations. Each creator agrees to indemnify and hold harmless the Platform operator from and against any claims, losses, damages, liabilities, costs, or expenses arising from a breach of these obligations, to the fullest extent permitted by applicable law.

Nothing in this provision shall affect any mandatory consumer rights or limit or exclude the liability of the Platform operator where such limitation or exclusion is prohibited by applicable law.
